INTRODUCTION
Heartsend LLC (“We”, “Us”, “Company”, “Heartsend”) takes your privacy seriously, and we want you to know how we collect, use, share, and protect your Personal Identifiable Information (defined below). This policy (the “Privacy Policy”) tells you what information we collect through our website (“Site”), mobile application (“App”) and any other services that we may develop and offer in the future (collectively, “Services”).
Please read this Privacy Policy to understand our policies and practices regarding the collection, use and treatment of your information. By using, accessing, or registering with Heartsend, you consent to our collection, use, processing, and disclosure of information in accordance with this Privacy Policy. You also acknowledge and agree that we are not responsible for how third-parties, vendors, and service providers collect or use your information. IF YOU DO NOT AGREE TO THE PRIVACY POLICY, INCLUDING ANY CHANGES THERETO, THEN YOU MUST NOT ACCESS AND USE THE SERVICES.
INFORMATION COLLECTED
Information You Provide Directly. You may provide information to us when you use our Services, including when you upload, register with, or log into our Site or App. This information may include, but is not limited to, your Personally Identifiable Information (“PII”) including, name, work email address, State, City, Race/Ethnicity, Role and password, and other information that may identify you. Once you have registered, we may collect the following information about you, including:
- Your age and certain optional health information;
- Employee email and phone;
- City, State;
- Job Title/Role;
- Age;
- Gender;
- Information you grant us access to when you access or use the Services; and
- In the event you pay for the Services directly, payment information is provided directly to our payment processing partner.
Certain information you provide when you use our Services and related features may be stored in our app database. In addition, your activities on your computer device outside of the Site or App may result in such information being transmitted to or otherwise collected by authorized or unauthorized third-parties, including through the other apps you access, the websites you visit, and by parties who may gain unauthorized access to your computer or data. Any information stored on your computer device or transmitted over any data network could be accessed or intercepted by unauthorized third parties. As a result, you acknowledge that Heartsend cannot assure that the information you submit through the Services or store locally on your computer device will remain private. Any data you provide or store locally through the Services is at your own risk.
Non-Personal Information. You may also provide Non-Personal Information (“NPI”), such as terms used for searches within the Site, the App, responses to questions, schedules, bookmarks, notes, and other information about your activities within and usage of the Services. Unless otherwise noted within the Site, App or in this Privacy Policy, any information you provide through may be processed by, transmitted to, or stored by Heartsend and/or its third-party providers.
Information We Collect Automatically. If you access, or use the Services, we may receive and store certain information about you and your mobile device(s) automatically using automatic data collection technologies, including but not limited to first- and third-party Cookies, log files, Web Beacons, Pixels, dynamic tag management and other technical means. This information may include, without limitation:
- Your IP address;
- Information associated with your Internet or mobile service provider or your account with your Internet or mobile service provider;
- Information associated with your Amazon, Apple iTunes or Google Play accounts or any other account use to download or access the Site or App;
- The Service content you view and/or download, search terms you enter, features you use, and the date and time of your visits;
- Information about the webpages you visit from the Site or App or before you came to or after you leave the Site or App; and
- Information collected by third-party advertisements on the Site or App, from third parties providing services to us, and from third parties with whom Heartsend advertises.
Cross-Device Tracking. Heartsend’s Site and App may permit you to roam and access services, preferences, and content across your computing devices from phones to tablets. Rather than residing as a static software program on your device, key components of the Services are cloud-based, updated periodically, to provide you with the latest improvements and features. In order to provide this experience, we collect data about you, your device, and the way you use our Services.
Tracking Technologies and Cookies. Heartsend uses Cookies and similar tracking technologies to track the activity on the Site and App and stores certain information. Tracking technologies used are beacons, tags, and scripts to collect and track information and to improve and analyze Heartsend services. You can instruct your browser to refuse all Cookies or to indicate when a Cookie is being sent. However, if you do not accept Cookies, you may not be able to use some parts of our Services.
HOW WE USE YOUR DATA
Heartsend Retentions and Transfer of Data. Heartsend respects your privacy and will not sell your PII to third parties. We may use your Personal Information to provide services to you, respond to your inquiries, provide information on products and services you request or have a representative contact you regarding our products or services. Unless you have otherwise opted out of receiving email communication from us, you agree by using our Services, to allow us to use your email for communication and provision of services consistent with this Privacy Policy. We will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy and no transfer of your PII will take place to third parties unless there are adequate controls in place including the security of your data and other personal information.
Sharing Data with Third Parties. From time to time, Heartsend may use third parties to provide products, services or otherwise support our business or collaborate with third parties with respect to development, promotion or other business activities related to a particular product or service. These third parties may include service providers of a sponsoring employer or employer-provided health plan. As permitted under HIPPA, we may disclose PII that we collect or you provide to contractors, Business Associates service providers and other third parties for solely for purposes of providing our services. We will not sell or rent your Personal Information to third parties or disclose any Personal Information we gather from you on our Services to third parties.
Heartsend Data Anonymization. We may also use your PII to update you on special offers related to our products or services, improve our products and services, provide product announcements or information regarding health topics, deliver other information we believe you will find most relevant, and useful and in any other way we may describe when you provide the information or to which you consent. We may occasionally contact you to gather customer service information to help us determine how we can improve our services and products to better meet your needs. We may also de-identify and/or aggregate your data for various business purposes including product, service and program development and improvement. De-identified data, in individual or aggregated form, may also be used for research purposes both internally by Heartsend or with research partners and other third parties for the advancement of clinical and scientific knowledge. We use the general information we collect from you to help us understand and analyze users of our services, including generating aggregate statistics about services use. This data can then be used to tailor Heartsend’s content and deliver a better experience for you and our users. We may also collect, aggregate and maintain anonymous information about the visitors to the Site and App. We may further share such aggregate, non-identifiable information with business partners, sponsors and other third parties.
RETENTION OF YOUR DATA
Heartsend retains your PII for as long as necessary to provide our services and fulfill the transactions you have requested, or for other essential purposes, including complying with our legal obligations, maintaining business and financial records, resolving disputes, maintaining security, detecting and preventing fraud and abuse, and enforcing our agreements. If you access our services through a subscription sponsored by your employer, we retain your employer contact details after the termination of your employer’s subscription to continue to communicate with you.
INTERNATIONAL APP USERS
Heartsend is based in the United States and, regardless of where you access our Services, the information collected as part of that use will be transferred to and maintained on servers located in the United States. Any information we obtain about you will be stored in accordance with U.S. privacy laws, regulations, and standards, which may not be equivalent to the laws in your country of residence. By using the Services, you consent to this collection, transfer, storage, and processing of information to and in the United States in accordance with the foregoing. Heartsend uses various tools to track your online activities to provide you with tailored advertising. You have the right not to decline decisions based solely on automated processing.
LINKS TO OTHER SITES AND SOCIAL NETWORKS
Heartsend may maintain a presence on third-party sites, including Facebook, LinkedIn, Twitter, and other social networks. We do not control and are not responsible for the collection, tracking, use, or disclosure of your PII and NPI gathered through social networking websites and applications, including through any potential Heartsend pages or profiles within other applications, or otherwise as a result of your participation in social networking sites. Third-party social networking applications and advertisers on these applications, including profiles within these sites, are not obligated to follow or apply this Privacy Policy. If you have any questions about an advertisement or other targeted content, you should contact the responsible social networking provider directly and refer to the applicable privacy policy and terms of use of that social networking provider.
CALIFORNIA CONSUMER PRIVACY ACT (CCPA)
California Civil Code Section 1798.83 permits users of Heartsend Services that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes.
Right to Correct Personal Data. You have the right to have information held about you corrected if it is not accurate.
Right to Access Personal Data. You have the right to make a request for a copy of the personal data that Heartsend holds about you. To make this request as an individual or an authorized third party, you can contact Heartsend at the below referenced contact information.
Right to Object to Use of Personal Data. You have the right, in certain circumstances, to object to Heartsend processing your personal information. If you have questions about this right, please contact Heartsend at the below-referenced contact information.
To Opt-Out of Marketing Messages. If you no longer want to receive marketing messages from Heartsend, you can elect to opt out of all marketing communications or only selected methods (e.g., email, phone or post). Opting out does not mean that you will not still receive service-related messages, other communications from us regarding transactions you undertake with Heartsend, or messages that we have another lawful basis for sending.

Right to restrict use of your data. If you feel the data we hold on you should not be processed in a particular way or for a particular purpose, please contact Heartsend at the below-referenced contact information.
Right to erasure. In certain circumstances you have the right to request that we erase personal data of yours that we hold. If your contract with Heartsend has been terminated, then we may still have lawful grounds to process your personal data. Restrictions: Children Under the Age of 13. Our Services are not intended to be used for children under 13 years of age without parental supervisions. No one under age 13 may provide any Personal Identifiable Information to the Site or App. Heartsend does not knowingly collect PII from children under the age of 13. If we learn we have collected or received PII from a child under 13 without verification of parental consent, we will delete that information. If you believe we might have any information from or about a child under 13, please contact Heartsend at the below-referenced contact information.
California Do Not Track Disclosure. Heartsend does not have a mechanism in place for responding to browser “do not track” signals or other similar mechanisms used to limit collection of information for use in the Site or App. To request correction or deletion of any PII that you have provided to us. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect, or if we have a lawful basis for continuing to process such information. If you withdraw a registration or cancel a subscription or delete the App, we may retain your PII in our records and we may continue to use and disclose that data in a manner consistent with this Privacy Policy, unless you request deletion of it.
CHANGES TO THIS PRIVACY POLICY
Heartsend reserves the right update this Privacy Policy from time to time. Any changes will be posted on this page with an updated revision date. If we make any material changes, we will provide notice through the services or by other means.
